Terms of Service — Build Me Web

Agreement

By creating an account, starting a project, or using Build Me Web (“we,” “us,” or “our”), you agree to these Terms of Service (the “Terms”) and our Privacy Policy. If you use the Services on behalf of an organization, you represent that you have authority to bind that organization, and “you” includes that organization.

If you do not agree to these Terms, do not use the Services.

Accounts

You must provide accurate account information and keep your credentials secure. You are responsible for activity under your account. Notify us promptly if you suspect unauthorized access. We may require additional verification for security or compliance.

Services

Build Me Web provides websites, commerce, applications, AI features, cloud hosting, analytics, and related tools (the “Services”). Features may vary by plan. We may update, improve, or discontinue parts of the Services with reasonable notice when practical.

Beta or preview features may be offered as-is, may change without notice, and may be less reliable than generally available features.

Acceptable use

You agree not to misuse the Services. Without limitation, you must not:

Violate applicable laws, regulations, or third-party rights
Upload or distribute malware, phishing, spam, or harmful content
Attempt to probe, scan, or breach security or authentication measures
Overload or disrupt infrastructure, or resell the Services without authorization
Impersonate others or misrepresent your affiliation with any person or entity

We may investigate violations and suspend or terminate accounts that breach these rules.

Your content

You retain ownership of content you submit to the Services (“Customer Content”). You grant us a limited license to host, process, transmit, and display Customer Content solely to provide and improve the Services as directed by you.

You are responsible for Customer Content and for obtaining any rights needed to use it with the Services. You must not submit content that infringes others’ rights or that you are not authorized to use.

If you use AI features, outputs may be generated based on your inputs. You are responsible for reviewing outputs before relying on them in production.

Plans and billing

Paid plans are billed according to the pricing and billing cycle shown at purchase or in your account. Fees are generally non-refundable except where required by law or expressly stated otherwise.

You authorize us and our payment processors to charge your payment method for applicable fees and taxes. Failure to pay may result in suspension or termination of paid features.

We may change pricing with notice. Continued use after a price change takes effect constitutes acceptance of the new pricing for subsequent billing periods.

Intellectual property

The Services, including software, design, trademarks, and documentation, are owned by Build Me Web or our licensors and are protected by intellectual property laws. These Terms do not grant you any rights to our trademarks or branding except as needed to use the Services.

Confidentiality

If either party shares non-public information marked confidential or that should reasonably be understood as confidential, the receiving party will protect it with reasonable care and use it only for purposes related to the Services. This does not apply to information that is public, independently developed, or rightfully received from another source without restriction.

Disclaimers

THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE.

Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BUILD ME WEB AND ITS AFFILIATES WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, DATA, OR GOODWILL.

OUR TOTAL LIABILITY FOR CLAIMS ARISING OUT OF OR RELATED TO THE SERVICES OR THESE TERMS WILL NOT EXCEED THE AMOUNTS YOU PAID US FOR THE SERVICES IN THE TWELVE (12) MONTHS BEFORE THE CLAIM AROSE.

Suspension and termination

You may stop using the Services at any time and may close your account through account settings or by contacting us. We may suspend or terminate access if you breach these Terms, if needed to protect the Services or other users, or if required by law.

Upon termination, your right to use the Services ends. We may delete Customer Content after a reasonable period, subject to legal retention requirements and any export features available before closure.

Changes to these Terms

We may update these Terms from time to time. We will post the updated version on this page and revise the “Last updated” date. If changes are material, we will provide additional notice when required. Continued use of the Services after changes become effective constitutes acceptance of the updated Terms.

Governing law

These Terms are governed by the laws applicable in the jurisdiction where Build Me Web primarily operates, without regard to conflict-of-law principles. Courts in that jurisdiction will have exclusive venue for disputes, except where applicable law requires otherwise for consumers.
